Statement of Rights and Responsibilities
Please read these Terms of Use carefully. These Terms of Use govern your access and use of the RollBol.com websites and mobile sites (collectively, the “Site”) as well as the provision and sale of products and services by KATERMAN LLC and/or its affiliates and/or fulfillment providers, as the context may require (“RollBol.” “we,” “us,” or “our”).

This Statement of Rights and Responsibilities is our terms of service that governs our relationship with users and others who interact with KATERMAN LLC, as well as RollBol brands, products and services. By using or accessing the RollBol Services, you agree to this Statement, as updated from time to time. Additionally, you will find resources at the end of this document that help you understand how RollBol works.

Because RollBol provides a wide range of Services, we may ask you to review and accept supplemental terms that apply to your interaction with a specific app, product, or service. To the extent those supplemental terms conflict with this Statement of Rights and Responsabilities, the supplemental terms associated with the app, product, or service govern with respect to your use of such app, product or service to the extent of the conflict.

Every offer of a RollBol product and/or service on our Site as well as every transaction, order and agreement that is concluded through our Site is governed by our Terms. The applicability of any terms and conditions of the customer or any third party on behalf of the customer is expressly dismissed and shall not apply, even if RollBol has not specifically rejected them.

RollBol reserves the right to make changes to this Site and to these Terms of Use at any time without prior notice. You should review these Terms of Use each time you access this Site.

You also agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website. You may withdraw your consent to receive communications from us electronically by contacting customer care. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.

 

 Use of Site

You are granted permission to access and use this Site and its Content and to create an account for the sole purpose of preparing, evaluating, and ordering products or services solely through RollBol (referred to herein as “Products”). No other download, retention, use, publication, or distribution of any portion of the Content is authorised or permitted. Obtaining Products from RollBol does not entitle you to use any portion of Content apart from the finished printed Products as they are supplied to you by RollBol. You agree to use this Site in a responsible manner that is in full compliance with these Terms of Use and with your local laws and regulations, including export and import regulations. Without limitation, no portion of Content may be utilized as a trademark or service mark, for any pornographic use, for any unlawful purpose or use, to defame any person, to violate any person’s right of privacy or publicity, to infringe upon any copyright, trade name, trademark, service mark or other intellectual property right of any person or entity. You agree that you will not use the Site to produce Products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious or otherwise objectionable. RollBol reserves the right, in RollBol’s sole discretion, to refuse to accept any content provided by you to RollBol or to process any order at any time and for any reason. RollBol also may terminate its service to and/or the accounts of customers found to be using RollBol to engage in undesirable activities or otherwise violating these Terms of Use. You agree that RollBol shall have no liability of any kind to you or to any third party arising from such refusal or termination. You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products. By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order and you authorize RollBol to produce the Products on your behalf. You grant RollBol the right to copy, modify, distribute, use, create derivative works of and vectorize any content you have uploaded for the purpose of fulfilling your order and/or marketing products or services to you. Moreover, you warrant that you have sufficient rights to permit RollBol to copy, distribute, use, modify, create derivative works of and vectorize any uploaded content for the purpose of fulfilling your order and/or marketing products or services to you. When you create an account during registration, you are able to personalize products and save these designs for future use or ordering. You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.

 

Privacy

Your privacy is very important to us. We designed our Data Policy to make important disclosures about how you can use RollBol to share with others and how we collect and can use your content and information. We encourage you to read the Data Policy, and to use it to help you make informed decisions.

Sharing Your Content and Information

You own all of the content and information you post on RollBol, and you can control how it is shared through your privacy and application settings. In addition:

1. 1. For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with RollBol (IP License). This IP License is for the purpose of making available the RollBol Services provided to you and to others that access or use RollBol Services, and ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
   2. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that, due to the technology employed by RollBol’s system, the removed content may persist in backup copies for a reasonable period of time (generally, for a maximum of 90 days after deletion begins, but will it not be available to other users during that time). Notwithstanding the foregoing, if required by applicable law, order of any government agency or judicial body, or the like, we may retain the content to the extent necessary therefor.
   3. When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of RollBol, to access and use that information, and to associate it with you (i.e., your name and profile picture).
   4. We always appreciate your feedback or other suggestions about RollBol, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).
      

Safety

We do our best to keep RollBol safe, but we cannot guarantee it. We need your help to keep RollBol safe, which includes the following commitments by you:

1. 1. You will not post unauthorized commercial communications (such as spam) on RollBol.
   2. You will not collect users’ content or information, or otherwise access RollBol, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
   3. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on RollBol.
   4. You will not upload viruses or other malicious code.
   5. You will not solicit login information or access an account belonging to someone else.
   6. You will not bully, intimidate, or harass any user.
   7. You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
   8. You will not develop or operate a third-party application containing alcohol-related, dating or other mature content (including advertisements) without appropriate age-based restrictions.
   9. You will not use RollBol to do anything unlawful, misleading, malicious, or discriminatory.
   10. You will not do anything that could disable, overburden, or impair the proper working or appearance of RollBol, such as a denial of service attack or interference with page rendering or other RollBol functionality.
   11. You will not facilitate or encourage any violations of this Statement or our policies.
       

Registration and Account Security

RollBol users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

1. 1. You will not provide any false personal information on RollBol, or create an account for anyone other than yourself without permission.
   2. You will not create more than one personal account.
   3. If we disable your account, you will not create another one without our permission.
   4. You will not use your personal timeline primarily for your own commercial gain, and will contact us on : [email protected].
   5. You will not use RollBol if you are under 18.
   6. You will not use RollBol if you are a convicted sex offender.
   7. You will keep your contact information accurate and up-to-date.
   8. You will not share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account.
   9. You will not transfer your account (including any Page or application you administer) to anyone without first getting our written permission. 

Protecting Other People’s Rights

We respect other people’s rights, and expect you to do the same.

1. 1. You will not post content or take any action on RollBol that infringes or violates someone else’s rights or otherwise violates the law.
   2. We can remove any content or information you post on RollBol if we believe that it violates this Statement or our policies, including the Community Standards, or where required by law..
   3. We provide you with tools to help you protect your intellectual property rights.
   4. If we remove your content for infringing someone else’s copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
   5. If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.
   6. You will not use our copyrights or Trademarks or any confusingly similar marks, except as expressly permitted by our Brand Usage Guidelines or with our prior written permission.
   7. If you collect information from users, you will: obtain their consent, make it clear you (and not RollBol) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
   8. You will not post anyone’s identification documents or sensitive financial information on RollBol.
   9. You will not tag users or send email invitations to non-users without their consent. RollBol offers social reporting tools to enable users to provide feedback about tagging.
      

Payments

If you make a payment on RollBol, you agree to our Payments Terms unless it is stated that other terms apply.

 

Terms of Sale

Before you can place an order online, you must have a RollBol account which is created by completing the registration form on the Site. The customer will at all times be responsible for each and every use of the account. RollBol has the right to refuse any request made by you and to close your RollBol account immediately in the event of any breach of these Terms. All our offers and promotions are without any obligation and subject to availability and confirmation of the order. An agreement between you and RollBol is subject to our acceptance of the order and will be formed when you receive the Order Confirmation by email. Copyrighted Materials for Limited Use This Site contains graphics, photographs, images, document layouts, artwork, text, fonts, music, software tools, and other information (referred to herein as“Content”). This Site and all Content are the copyrighted property of KATERMAN LLC, and/or its subsidiaries (referred to herein as “RollBol”) or the copyrighted property of parties from whom RollBol has licensed such property. All rights in this Site and its Content are reserved worldwide. It is strictly prohibited to retain, copy, distribute, publish, or use any portion of the Content except as expressly allowed in these Terms of Use. RollBol reserves the right to add to, delete from, or modify any part of Content at any time without prior notice. Any modifications to Content, whether by You or RollBol remain the property of RollBol and its licensors.The logo design tools provided on this Site employ a limited number of elements, including icons, fonts, colour schemes, and design effects. RollBol reserves the right to use all such elements and to make all such elements available for use by other parties in the future. You do not obtain any right or claim to any of the individual logo design elements through your creation of a logo design and/or your incorporation of a logo design into one or more products. Other RollBol customers may use the design tools to create logos that have similar or identical combinations of these elements and RollBol does not guarantee that your logo will not have similarities to logos designed and used by other parties. RollBol provides no warranty of any kind that logo designs created using the design tools will not infringe, or be subject to a claim of infringing, the trademark or other rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether the logo design is legally available for your use and does not infringe the rights of another party. Transfer of Title The customer agrees that the risk of loss and title for any printed Product pass to you upon our delivery to our carrier. For any Product that is to be provided to the customer in an electronic format, the customer agrees that delivery of such Product shall be deemed to have occurred either (a) at the time we transmit the Product via email or other electronic communication addressed to the customer or (b) at the time we transmit a notification to the customer that the Product is available for downloading from the Site.

 

Indemnification

You agree that you shall indemnify RollBol and all parties from whom RollBol has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material that was not part of the standard Site Content and that you uploaded or otherwise provided to RollBol or incorporated into Products. As to clause (ii), you agree that we have the right to control the defense of any such suit, claim or demand.

Disclaimer of Warranty

 

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU ACKNOWLEDGE THAT OPERATION OF THE SITE MAY NOT BE UNINTERRUPTED OR ERROR FREE. REFERENCES AND LINKS TO PRODUCTS OR SERVICES OF INDEPENDENT COMPANIES MAY APPEAR ON THE SITE. THESE REFERENCES AND LINKS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. 

Some jurisdictions may provide you with certain warranties or guarantees that cannot be excluded by contract (“consumer guarantees”), or only limited in certain circumstances, and nothing in these terms of use alter those consumer guarantees if it is illegal for RollBol to do so. If those consumer guarantees apply to you, and RollBol cannot legally exclude those consumer guarantees, then to the maximum extent permitted by law, RollBol: (1) excludes or limits those consumer guarantees; and (2) limits its liability at the option of RollBol to the following: (a) in the case of services, the supply of the services again or the payment of the cost of having the services supplied again; (b) in the case of goods, the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired.RollBol’s Satisfaction Guarantee is good for 10 years following your purchase. If you request a refund, the time it takes for your refund to arrive may depend on your bank. In most cases, you should receive your refund within 30 days. Certain circumstances are beyond RollBol´s control and may not be covered by the Satisfaction Guarantee. Please note that we cannot be responsible for: Spelling, punctuation or grammatical errors made by the customer, inferior quality or low-resolution of uploaded images, design errors introduced by the customer in the document creation process, errors in user-selected options such as choice of finish, quantity or product type, and damage to the products arising after delivery to the customer.Please preview your designs carefully and correct any mistakes prior to placing your order. RollBol does not proof documents created by its customers prior to processing.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROLLBOL OR ITS LICENSORS, SUPPLIERS, OR VENDORS, THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT ROLLBOL HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SITE OR OF FAILURE TO PROVIDE PRODUCTS OR SERVICES THAT YOU ORDER FROM ROLLBOL OR ITS AFFILIATES, INCLUDING WITHOUT LIMITATION, DAMAGES ARISING FROM MISTAKE, OMISSION, VIRUS, DELAY, OR INTERRUPTION OF SERVICE. IN NO EVENT SHALL ROLLBOL BE LIABLE OR RESPONSIBLE FOR ANY DAMAGES OR CONSEQUENCES ARISING FROM OR RELATED TO YOUR INAPPROPRIATE OR UNAUTHORISED USE OF THIS SITE OR ITS CONTENT.

Site Feedback

Any comments, suggestions, proposals or other feedback (collectively “Feedback Information”) provided to RollBol in connection with the operation or content of this Site shall be provided by the submitter and received by RollBol on a non-confidential basis. All such comments, suggestions, and other information shall become the exclusive property of RollBol. By submitting any such information to RollBol, you agree that you are transferring and assigning, at no charge, all of your right, title and interest in the information, including all copyrights and other intellectual property rights. You agree that RollBol shall be free to use such information on an unrestricted basis. Privacy RollBol has set out in its Cookies and Privacy Policy how we collect, use, disclose, store and protection the information that you submit to us during the use of our Site. This Cookies and Privacy Policy applies to every Site visit, every use of our services, and every transaction and agreement that is concluded through our Site. Miscellaneous You must be at least 18 years old or otherwise have parent or guardian permission to use this Site. By using this Site, you represent and warrant that you are at least 18 years old or have that permission. In the event any provision hereof is found to be unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the extent necessary to allow enforceability of the provision as so limited, or, if a deemed modification is not satisfactory in the judgment of that court, the unenforceable provision shall be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected thereby. Governing Law The party you are contracting with and the seller of the products and services offered and sold on this Site is KATERMAN LLC, a limited company organised under the laws of the Delaware with its headquarters in Venlo, the Delaware. All issues related to the protection, infringement, or misuse of copyrighted materials shall be governed by the copyright laws of the United States of America. All other matters relating to your access to or use of this Site shall be governed by the laws of the Delaware. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Amsterdam, the Delaware. You agree to submit to the jurisdiction of courts sitting in Amsterdam, the Delaware and agree that venue in these courts is proper in any such legal action or proceeding. You also agree that you not to assert in any legal action or proceeding involving RollBol that a court sitting in Amsterdam is an inconvenient forum for such legal action or proceeding.
